Imitating fast-paced-Paul Wellstone
Minnesotans (of a certain age, and perhaps a certain inclination) will recall this legendary TV ad that introduced the 1990 longshot Senate candidate Paul Wellstone.
If so, they might be a little taken aback at the brazenness of this rip-off by longshot Senate candidate Mickey Kaus in California.
Kaus, as you can infer, is challenging incumbent Dem. Senator Barbara Boxer in the California primary.
I'm seeking comment from Bill Hillsman (who made the original Wellstone ad) and Jeff Blodgett, who became Wellstone's top political aide. I did reach Vaughn Juares, who works with Hillsman and said he specializes in these kinds of intellectual property issues and he doubted there was any serious legal or ethical problem with the copycat version.
Just heard back from Jeff Blodgett, who was also inclined to be a good sport about the theft-of-concept. Imitation is the highest form of flattery and all that. Blodgett said he's seen other copycat versions of "Fast-paced Paul" through the years, although not one like this with a first line that is almost verbatim.
Kaus, by the way, is a blogger whose career has been in journalism. I knew him slightly years ago when he edited a piece I wrote for the Washington Monthly. Hi Mickey.
Hat-tip to Ben Smith of Politico.

What this ad suggests to me is that someone felt Wellstone's ad years ago was a good and effective way to get public attention.
Not quite sure how "brazen" fits, though -- I don't recall that Wellstone copyrighted it. Or did he?
Kind of nice to be reminded of those golden days, I think. Thanks for bringing it up.
I'd think that this falls more into the 'homage' category. There is a strong outsider connection between Wellstone and Kaus. It'd be nice if we had a DFL candidate who wasn't so mesmerized by unions...
I love that old Wellstone ad. The fact that it was copied (intentional or not) seems like a compliment.
Announcing his ad on his website. Kaus acknowledges that it was based on Wellstone's ad and Northwoods Advertising also, including a link.

Kaus definitely knew he was copying the Wellstone ad; the first lines are nearly identical. I agree that it is homage and he is hoping to break in from the outside, as Wellstone did. Though Wellstone did not earn my vote in 1990, that ad resonated with me. It still stands out; I can't think of a better campaign ad in the past twenty years.

Eric, you're the law guy at MinnPost nowadays. Why aren't you publishing any stories on Peter Erlinder? The Star Tribune's coverage isn't necessarily insightful, but at least it's there! Aren't you embarrassed to be scooped?
