    Impatience in Coleman-Franken-land?

By Eric Black | Published Tue, Jun 30 2009 9:31 am

NBC's Political Director Chuck Todd sort of predicts a Franken-Coleman MN Supreme ruling today. Writing in "First Read," a daily political tip sheet, Todd says:

"Are we going to get a decision today from the Minnesota Supreme Court regarding the state’s never-ending recount?
It’s the last day of the month, and we were led to believe the court would have a decision by then. (Remember that the court heard oral arguments on June 1.) With the race still unresolved, here’s a look at it by the numbers:

    • -- $51.1 million has been raised between Coleman and Franken for the entire campaign
    • -- $50.3 million has been spent between the two candidates
    • -- $11 million (at least) has been spent on the recount
    • -- 2,424,946 votes were cast
    • -- 312 votes separate the candidates (Franken leads)
    • -- 239 days since Election Day 2008
    • -- 34 weeks since Election Day 2008
    • -- 7 months, 27 days since Election Day 2008
    • -- 4 seasons seen since Election Day 2008 election"

You'll note that Todd doesn't actually claim to have anyone telling him that today's the day, nor do I, although some of my sources, also purple with impatience, have mentioned the end-of-the-month theme.

Maybe it's my fault. Back in Mid-April I laid out my version of the step-by-step likeliest scenario and -- stupidly -- said that if every step occurred in the likeliest way, Franken would be seated in "roughly" May or June.

Every step so far has gone the way I said was likeliest, but the current step has taken longer than it was supposed to. But if you're dumb enough to commit such speculation to pixels, you gotta be willing to acknowledge that, as of the close of court business today, my prediction will officially be wrong.

And, if you think about it, whoever "led [Chuck Todd] to believe" that the court would have a decision by June 30 was just guesstimating. It's not as if the ruling has been written and waiting for a particular publication date.

One might note, if one were getting edgy, that, according to Minnesota statutes 209.09 (subd. 2) combined with 209.10 (subd. 4), the appeal of the election contest in the Franken-Coleman case "takes precedence over all other matters before the Supreme Court."

Yet the court has managed to crank out quite a few other rulings while the appeal of this election contest -- the biggest one they will ever get -- has remained under advisement. Yes, we're getting squirrelly out here. But I counsel patient shirt-keeping-on because, after all, what choice do we have, other than shirtlessness?
