Late Wednesday, the Franken campaign filed a response to a letter sent earlier in the day by the Coleman campaign to the Minneapolis city elections chief. In that letter, Coleman campaign lawyer Fritz Knaak argued that, in their absence, the missing 133 votes from the Dinkytown precinct shouldn’t be counted.
Marc Elias, the Franken lawyer, stated his opposition to that Wednesday and filed an 11-page brief backing it. The Franken campaign wants the Election Night results from the Minneapolis precinct to be counted, not the inaccurate recount number.
Franken would gain 46 votes if the Election Night tally counted.
