    Coleman-Franken trial update: Sides agree not to count 'late' absentee ballots

    This afternoon’s court session began with an agreement!
     
    The Coleman side now says that all absentee ballots received late will not be challenged. So, one category has been stipulated to by both sides.

    Other than some overseas military ballots that arrived late, the Franken side has long stated that only legally cast ballots should be counted. A late-received vote is generally considered illegal.

     So, both side now agree that if election officials received an absentee ballot after Election Day, it won’t be counted. That's the law. But there had been some late ballots -- about 170 -- that the Coleman side had said should be re-examined.

    Meanwhile, in the massive filing of the Minnesota Republican Party, we found some more payments to Coleman lawyer Tony Trimble’s firm.

    That total now stands at $266,288.
