Very nice. Minneapolis is truly the city of lakes and parks and rivers. Which makes me wonder why an out-of-town (and out-of-state) company is being hired to do the design. I hope this isn't the same outfit that blew the design and implementation of the green space over the freeway in Boston, named after Rose Kennedy, that failed because no one uses it. Seriously, folks. Those of us who grew up in Minneapolis and love our water-based heritage, wonder about this.

There will be a big surprise when the US SC finally rules on the health care law. The winning issue will be protecting the health care system from free loaders (those with no health insurance who show up at hospitals for treatment) by requiring everyone to habe insurance. An obvious fit within the Commerce Clause. Scalia will love it. The 11th Circuit will go for it, too.

What is the flexibility the Republicans want? My guess is they want to pay less to fewer people. Flexibility??? What a misuse of language. They
are simply meanspirited. They want to make cuts before the (already) increasing revenue clears up their deficit.

The idea that every legislative act should have been stated in the constitution is false. The enumeration argument failed during the Constitutional Congress when the Framers reached a compromise. The protesters do not know the history of our democracy. Even the Framers who had wanted enumeration accepted the compromises and behaved responsibly. Remember, the need for a new constitution resulted from the numerous problems that occurred under the Articles of Confederation which the U.S...

The picture you show of Tony Sutton is the perfect image of someone who takes himself too seriously. Ouch!

Posted on 07/01/10 at 11:02 am in response to Taking Tentherism seriously in Minnesota

The 10th Amendment was a compromise between those who wanted to "enumerate" the federal powers and those who wanted to leave the potential powers unenumerated and therefore open in order to allow for changing circumstances over time. The compromise clearly favored the "no enumeration" side of the debate. The US Supreme Court (which, as Justice John Marshal wrote, "says what the law is") has over its many years of interpreting the Constitution never upheld a "tenther" type claim. The...

She has accomplished making a fool of herself and of her state. As a born and raised Minnesotan, I cringe when I hear her spout such idiotic and false comments.I don't understand why her supporters don't pay attention to facts rather than old John Bircher nonsense.

I understand that the iron rnge people need jobs. But please do not elect someone who wants to mine nickel and copper. Nickel especially is disastrous to the environment. Drive up to Sudbury, Ontario sometime and look at the miles of wasteland (literally) that were created by open pit nickel mines -- no trees, nothing green, black rock everywhere. The environment of the north woods would be devastated.

As one who taught Constitutional Law for 30 years, I commend your quicky effort. The relationship between the enumeration issue and the Bill of Rights deserved more attention, but I hope the tenthers read this and try to understand it instead of relying on opinions spouted by the ignorant. These opinions are not only inaccurate but silly. The rational citizen should pay no attention to the ignorant babblings of those who have never studied the Constitution and its extensive case law.

Jay Weiner, you should be ashamed to use such a cutsey line. This suggests that the ECC judges
simply voted, as in an election -- that implies that they are "activists" and not real judges. Shame on you.
