A judge who has been accused of conflict of interest after dismissing thousands of lawsuits against Medtronic responded Monday, saying he will not remove himself from the case.
Lawyers for the plaintiffs say Judge Richard Kyle should have recused himself from the lawsuits over defective Medtronic defibrillator wires because his son works for the law firm that represents the company.
In an order Monday, the Associated Press reports, Judge Kyle says he was not obligated to disclose the relationship. His son does criminal defense work for Fredrikson & Byron and does not work for Medtronic.
Under the plaintiff’s logic, Kyle wrote, judges would be required to “run conflict checks through the law firms employing their children, spouses, parents, aunts and uncles,” and “that logic would cripple the bench.” (More: Star Tribune)
